Terms & conditions for sales of stays at Clos Tellier

SUBJECT:

These general conditions of sale are intended for the use of booking stays in guest rooms at Clos Tellier, in Mareil-Marly. They constitute the reservation contract between Sarl ELR CONSEIL (Le Clos Tellier) which operates and manages the guest house Le Clos Tellier, and the customer for a stay in a guest room.

Acceptance and compliance with these conditions of sale are acquired upon payment to reserve a room. The owner of Clos Tellier, manager of ELR Conseil and the hostess, Emmanuelle de Rochegonde, undertakes to do everything possible to give customers a warm welcome, ensure them a pleasant stay and facilitate their knowledge of the region. The customer undertakes through his reservation to respect these general conditions of sale.

Duration of stay

The customer signing this contract concluded for a fixed period may not, under any circumstances, claim any right to remain in the premises.

Reservation

Reservations are made directly via the Clos Tellier website and payment is immediate and complete. A booking confirmation is sent as soon as payment is made.

Reservations can also be made directly by telephone or by e-mail contact. The payment terms are then to have paid for the room by bank transfer at least 15 days before the reservation date. An invoice is sent by email, accompanied by a RIB.

The reservation can be made through other Booking type platforms which apply their own payment and reservation method.

Room prices

The prices indicated on this site are prices in €uros VAT included per room and per night, for the number of people and for the dates chosen. Our prices are inclusive of all taxes. Breakfasts are included in the price. The tourist tax is indicated in addition to the price of the room, it is paid at the time of booking, Clos Tellier pays it quarterly to the Public Treasury.

Rates and offers are subject to availability at the time of booking and may not be renewed for subsequent reservations. Non-contractual conditions, prices and offers are subject to change without notice.

Consumer Code – right of withdrawal

A reservation made online, by telephone, and/or by mail is a distance purchase. This is a contract concluded remotely within the meaning of the definition given by the Consumer Code. Le Clos Tellier is subject to articles L. 121-17 et seq. of the Consumer Code. The right of withdrawal does not exist for contracts for hosting services.

Cancellation of the stay by the customer

Any modification is only possible after the agreement of Clos Tellier and may result in additional costs. We inform you that in the event of cancellation of the reservation before the start of the stay, the customer will be owed, as a penalty clause, compensation set as follows:

  • - if the cancellation occurs more than 4 weeks before the arrival date, the reservation will be refunded in full;
  • - if the cancellation occurs between 2 weeks and less than 4 weeks before the arrival date, the reservation will be refunded up to 70%;
  • - if the cancellation occurs less than 2 weeks before the arrival date, the reservation will be lost for the customer.

In the event of delayed arrival and/or early departure during your stay: full payment of the reserved service is due whatever the reason.

Cancellation insurance payable by the customer

We draw your attention to the fact that no cancellation insurance is included in our prices. It is therefore strongly recommended to subscribe to one.

Cancellation of stay by the owner

If, before the start of the stay, the owner has to cancel the reservation, he must immediately inform his customer by any means. The customer will then be immediately and fully refunded for the reservation.

Arrival time

Arrival is scheduled for the afternoon from 4:30 p.m., and possible until 7 p.m. In the event of a special request or unforeseen event, it will be necessary to contact us by telephone on 0033 (0)6 50 00 63 97 to notify us of any delay.

Departure time

Check-out time for rooms is 10:30 a.m.

Change of rooms

Without the customer being able to claim any compensation, the owner reserves the right to change the room initially reserved by the customer with a room of the same or greater capacity. In this case, the cost of the reservation remains unchanged.

Capacity

This contract is established for a specific number of people. If the number of customers exceeds this number, the owner has the right to refuse additional customers. This refusal cannot be considered as a modification or termination of the contract at the initiative of the owner. In the event of the customer's departure, no refund can be considered. Note that it may be possible, in certain cases and under certain conditions, to provide an extra bed, involving additional costs for the customer.

Breakfast

Breakfast included in the price of the night, which cannot be separated, is served every morning in the dining room. It is served between 8 a.m. and 10 a.m.

Pets

Pets are welcome, on the express condition that Le Clos Tellier is notified at the time of booking. Your hostess herself has three dogs and a cat, very accustomed to the greatest discretion towards guests and their possible pets.

Art of living and use of places

In order to guarantee the tranquility of the place and the comfort of the guests of Clos Tellier, respect for a certain “art of living” is required of all. The customer undertakes to respect the instructions for good manners indicated to him in these general conditions of sale:

  1. 1) In particular, you are asked not to smoke inside. Ashtrays are available for smoking outside, on the terrace or in the garden.
  2. 2) It is specified that the small kitchen in the guest house can be left at the free disposal of guests under certain conditions, in particular respect for other guests, cleaning and tidying up of the place after its use.
  3. 3) It is expressly requested not to dine or have lunch in the rooms, the dining room is available to guests for this purpose.
  4. 4) It is expressly recommended not to sleep on pillows with a wet head and not to place wet towels on furniture such as chairs/armchairs/beds.
  5. 5) The customer undertakes to return the rooms in perfect condition and free from damage at the end of the stay and to systematically declare – and to assume financial responsibility for – any damage for which he or she is responsible. Repair costs, including the time required for repairs, will be paid according to separate invoicing and on the basis of supporting documents for the costs incurred.

Guests' attention is drawn to the fact that minors operating on the property are placed under the sole and entire responsibility of their parents or persons having authority over them. Children must always be accompanied by an adult in our house and/or on the grounds. Your stay at Clos Tellier and the use of our equipment and facilities such as parking is done voluntarily and at your own risk.

Le Clos Tellier is not responsible for cases of loss, theft and/or damage or injury caused to property and/or people on the property, whatever the cause. Your hostess also expects her customers to report any inconvenience or contractual breach to her so that she can remedy it immediately if possible.

Insurance-Damage-Breakage-Theft

The Customer certifies having taken out civil liability insurance to cover any damage that may be caused in the establishment during the period of their stay. The Customer must ensure safekeeping of the goods and materials brought by him/herself. He is particularly invited to take out specific insurance in the event of the presence of large equipment or valuable goods to the extent that the establishment cannot be held liable in the event of damage or theft of said goods. The Customer is responsible for all damage caused by himself and undertakes, in the event of damage to the premises made available, to bear the costs of restoring these premises.

Under no circumstances can the establishment be held responsible for damage of any nature whatsoever, in particular fire or theft, likely to affect objects or materials left by the Customer on the occasion of the 'accommodation. Likewise, any parcel, package, etc. delivered to the guest house before and during accommodation may be received by the host but under no circumstances will the latter be responsible for any incident, any deterioration, incorrect number of packages, damaged packages, or any delivery problem. The Customer undertakes in the event of a problem to contact the supplier or carrier directly.

The Client and his insurers waive all recourse against the host, his staff and his insurers due to any direct or indirect damage resulting from the total or partial destruction of all materials, movable objects, fittings, any valuables, goods , as well as deprivation or disturbance of enjoyment of the premises.

Computer and freedom law

In accordance with Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms, you have the right to access and rectify data concerning you. We formally undertake not to transmit under any circumstances or in any manner the information that you have communicated to us to other companies or organizations.

The information transmitted is used exclusively to establish the invoice for the stay, contact the customer to find out their arrival time in the event that this has not been announced and respond to requests from the customer themselves.

The Customer is informed by Le Clos Tellier of the possibility of registering on the list opposing telephone canvassing.

Complaints and disputes

The General Conditions are governed by French law, without hindering any mandatory protective provisions that may be applicable in the country of residence of the consumers.

The Customer is informed by Le Clos Tellier of the possibility of resorting, in the event of a dispute relating to these General Conditions, to a conventional mediation procedure or any other alternative method of dispute resolution, under the conditions provided for in the Title I of Book VI of the Consumer Code.

After contacting Clos Tellier to attempt to resolve the dispute amicably, and in the event of a negative response or no response within sixty (60) days from the referral, the Client can contact the Tourism and Travel Mediator – BP 80303 – 75823 Paris Cedex 17.

Le Clos Tellier also informs the Client of the existence of a European Online Dispute Resolution (“RLL”) platform which he can use. The Customer can access it from the following link: https://ec.europa.eu/consumers/odr/.

Modification of the conditions of sale

These conditions of sale are subject to change at any time and without notice. Acceptance and compliance with these conditions of sale are deemed acquired as soon as the reservation is made.
